Terms and Conditions of Use

1. Introduction

The ASSOCIAÇÃO GIRLMOVE PORTUGAL (hereinafter referred to as “GIRLMOVE”), with the single registration and taxpayer number 513 976 191 and with head office Avenida Defensores de Chaves, 69, R/C Esquerdo, 1000-114 Lisboa, is the owner of the website available at https://www.girlmove.org/pt (hereinafter referred to as “Website”).

The present Terms and Conditions of Use (hereinafter referred to as “Terms and Conditions”) regulate access to and use of the Website, the use of which by the user (hereinafter referred to as the “User”) assumes and implies full and unreserved acceptance of all the Terms and Conditions.

Please read these Terms and Conditions carefully because they contain important information regarding your legal rights and obligations and constitute a binding agreement between the User and GIRLMOVE and are complementary to our Privacy Policy.

2. General Conditions

By accessing or using the Website in any way, you declare that (i) you have read and accepted these Terms and Conditions; and (ii) you have the necessary legal capacity to accept these Terms and Conditions. If you do not accept these Terms and Conditions, do not use or access the Website. The User is entirely responsible for accessing and using the Website.

GIRLMOVE reserves the right, at any time and without prior notice, to make any total or partial alteration to these Terms and Conditions. Continued use of the Website by the User constitutes full acceptance of any such amendments. It is the User’s responsibility to regularly check the Terms and Conditions. If you do not accept the changes, do not access or use the Website.

Without prejudice to the foregoing, GIRLMOVE will endeavour, as far as possible, to notify the User of alterations to these Terms and Conditions by means of advertising on the Website.

3. Website Description

GIRLMOVE’s website presents its purpose, mission and values, as well as the team behind this project. It also describes its mentoring programmes in which selected young women (hereinafter referred to as “Girl Movers”) are guided by reference leaders and, in turn, these young women guide, support and protect girls in vulnerable contexts.

The Website enables interested girls to apply by completing a form available in it. In addition, it contains photographs and testimonials of Girl Movers who have participated in the programmes since 2016, as well as videos of events.

Users are informed of the possibility of investing in a Girl Mover or receiving her in their company or institution; and also of making donations through the IRS, an education grant or bank transfer.

4. Freedom of Usage

The content available for access on the Website is or may be protected by any applicable legislation, namely as regards intellectual property and copyright. GIRLMOVE’s logos are also protected against any infringement of industrial property rights.

Unless otherwise stated, the contents of the Website are the property of GIRLMOVE and may not be copied, modified, sold, rented, distributed, licensed or sublicensed. The contents of the Website may only be quoted provided that the source is clearly identified, in accordance with the provisions of the Portuguese Copyright and Related Rights Code approved by Decree-Law no. 63/85, of 14 March, as duly amended.

Provided that the User respects these Terms and Conditions and the applicable legislation, the User has full freedom to use the Website, undertaking, however, to make good use of the contents and services of the Website, which may never be used for illegal activities or activities that may be contrary to public order or national defence.

In particular, the following activities are expressly prohibited:

a) To use the Website in any manner that is not permitted by these Terms and Conditions or that violates any law, regulation or rule of any applicable jurisdiction;

b) To use the Website in a fraudulent manner, or in any manner which is contrary to normal use of the Website;

c) To carry out illegal activities or activities that infringe the rights of GIRLMOVE, the User or other Internet users;

d) To reproduce, distribute or copy the Website for any purpose and without recourse to the right to quote provided for in the Copyright and Related Rights Code, unless expressly authorised by GIRLMOVE;

e) To interfere with or condition in any way the use of the Website or violate any rules, regulations or standards of the networks connected to the use of the Website;

f) To attempt access to unauthorised content on the Website or obtain information that is not intentionally made available to the User by GIRLMOVE; and

g) To introduce, transmit or make accessible in any way material that contains viruses, programmes, systems or files that destroy or limit the functionality and/or capacity of any computer, including software and hardware or electronic communications equipment.

The User agrees by these Terms and Conditions to notify GIRLMOVE immediately if it becomes aware of any unauthorised use of the content of the Website.

GIRLMOVE reserves the right to prosecute the authors of any copy, reproduction or other unauthorised use of the content of the Website.

5. Breach of Terms and Conditions

GIRLMOVE reserves the right to take all measures it deems necessary to safeguard its rights in the event of breach or attempted breach of these Terms and Conditions and may choose to suspend or block access to and use of the Website, without the User being entitled to any compensation or indemnity as a result of such fact.

6. Limitação da Responsabilidade

Under the terms and to the extent permitted by law, GIRLMOVE shall not be liable for damages of any nature whatsoever, in particular, resulting from the following circumstances:

a) Lack of functioning of the Website or incorrect functioning of the pages;

a) Uselessness, inadequacy or invalidity of the services and contents offered on the Website;

b) Frustration of the User’s expectations;

c) Existence of viruses or programs on the User’s computer.

The User is responsible for maintaining the necessary software (including anti-virus and other security procedures) for the correct functioning of the Website. 

7. Personal Data

GIRLMOVE processes your personal data in compliance with the applicable legislation on personal data, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation) and Law no. 58/2019, of 8 August, which ensures the implementation of the GDPR in the Portuguese legal order.

8. Suspension or Termination of the Website

The User acknowledges and accepts that GIRLMOVE has no obligation to provide, or continue to provide, access to and use of the Website or any fraction thereof. GIRLMOVE reserves the right, at its sole discretion, to suspend, restrict, block, deactivate or terminate its access to or use of the Website, at any time and without prior notice, without any compensation or indemnity rights resulting therefrom for the User.

The User acknowledges and accepts that GIRLMOVE shall not be held responsible for any content available on other websites or any hyperlinks available on the Website referring to other websites. GIRLMOVE does not control such third-party websites and the existence of such hyperlinks does not imply any sponsorship or commercial association with GIRLMOVE.

9. Duration

These Terms and Conditions shall apply for an indefinite period and may be altered by unilateral decision of GIRLMOVE. To that extent, we advise you to consult them regularly.

10. Applicable Law and Forum

The Website is managed by GIRLMOVE, which is based in Portugal. By accessing and using the Website, the User recognises and accepts that these Terms and Conditions are governed by Portuguese law.

The District Court of Lisbon has exclusive jurisdiction for the resolution of any disputes arising from the use of the Website , and the Parties expressly waive any other.
